Village of Republican City

The regular monthly meeting of the Board of Trustees was held on October 1, 2018, at 5:30 p.m. at the Fire Station with Trustees Eddy, Einspahr, Hammond, Orcutt and Valentine present. Clerk Waldo, Utility Supervisor Whetstine and Larry Steele were also present. Posted notices in three public places within the village. Notice of meeting and agenda was given to Trustees in advance. As required by law Acting Chairman Hammond pointed out the copy of the Opens Meeting Act posted on the wall for public viewing and called the meeting to order. Proceedings shown were taken while convened meeting was open to the public.

Motion by Einspahr, seconded by Valentine, to approve the minutes of the last meeting as published Voting Aye: Einspahr, Hammond, Orcutt and Valentine. There were no votes against the motion. Absent: Eddy. Motion carried.

Motion by Einspahr, seconded by Orcutt to pay the following bills:

Treasurer’s report was read and approved. Discussion was held regarding street fund. Motion by Orcutt, seconded by Einspahr to transfer $3500.00 from the General fund to the Street fund . Voting Aye: Einspahr, Hammond, Orcutt and Valentine. There were no votes against the motion. Absent: Eddy. Motion carried.

Larry Steele with Miller & Associates was present for the One and Six Year Street Improvement hearing. Motion by Einspahr, seconded by Orcutt to open the One and Six Year Street Improvement hearing at 5:40 pm. Voting Aye: Einspahr, Hammond, Orcutt and Valentine. There were no votes against the motion. Absent: Eddy. Motion carried. Discussion was held regarding the One and Six Year Street Improvement Plan. At this time, both one and six year plan is maintenance only. The village will receive approximately $28,755.00 in highway allocation/incentive funds from the state. Questions were raised regarding the cost of paving streets. Cost to concrete without curbs or gutters would be approximately $50,000 per block. Asphalt would be approximately half the price, but would last half the time of concrete. Paving districts were discussed. Cost of projects would be assessed to the property owners. Village is not eligible for CDBG funding due to our low to moderate income level is too high per the 2010 census. Motion by Orcutt, seconded by Valentine to close the One and Six Year Street Improvement hearing at 5:46 pm. Voting Aye: Einspahr, Hammond, Orcutt and Valentine. There were no votes against the motion. Absent: Eddy. Motion carried. Motion by Einspahr, seconded by Orcutt to pass Resolution 100118-1, setting the One and Six Year Street Improvement Plan as maintenance only. Voting Aye: Einspahr, Hammond, Orcutt and Valentine. There were no votes against the motion. Absent: Eddy. Motion carried.

Kris Eddy entered the meeting.

Motion by Valentine, seconded by Orcutt to approve the engagement letter from Contryman Associates, P.C. for the 2017-2018 audit at a rate not to exceed $7,900.00. Voting Aye: Eddy, Einspahr, Hammond, Orcutt and Valentine. There were no votes against the motion. Motion carried.

Michael McConnell was present to discuss the RCVFD. A gentleman from Omaha has offered $6500.00 for the 1980 equipment hauler and newly retired ambulance. Motion by Einspahr, seconded by Valentine to accept the offer pending any state statutes or limitations requiring that bids be solicited for these vehicles. Voting Aye: Eddy, Einspahr, Hammond, Orcutt and Valentine. There were no votes against the motion. Motion carried. Discussion was held regarding servicing of 2014 Ambulance. 5R Repair is months out from being able to service. McConnell will talk to 5R or Luke Bower regarding time frame to service. Alignment to be done at OK Tire in Franklin. Ben Pollard has asked to be removed from the department due to time and location constraints. Because he is currently insured for the next year, he will be removed at the end of the current insurance coverage. Internet service is needed in the fire hall. Extender from village office provides a weak signal. Clerk will contact Frontier regarding their wi-fi mesh extender that was discussed with Frontier technician previously.

Contract for playground/ shelter equipment is being worked on. Donation sign in shopping center needs to be updated.

Motion by Einspahr, seconded by Orcutt to open the Conditional Use Permit hearing for 210 Truman Ave. at 6:15 pm. Voting Aye: Eddy, Einspahr, Hammond, Orcutt and Valentine. There were no votes against the motion. Motion carried. The resident is requesting permission to rebuild their garage approximately 4 feet from the property line. Current zoning regulations require new construction to be a minimum of 6 feet from the property line. All requirements of the Conditional Use Permit were met including notifying all property owners within 300 feet of the property. No communication was received in writing or by phone from any property owner. Michael McConnell stated that he did not have any problem with the proposed garage being 4 feet from the property line. No further comments were made from the public. Motion by Orcutt, seconded by Valentine to close the hearing at 6:20 pm. Voting Aye: Eddy, Einspahr, Hammond, Orcutt and Valentine. There were no votes against the motion. Motion carried. Discussion was held regarding the building permit for 222 Truman Ave. Concern was raised regarding whether a building without living quarters was in violation of the minimum square foot zoning regulation due to the building being built on a lot that is separate from the house. Motion by Hammond, seconded by Orcutt to table the building permit until additional information could be obtained and discussion could be held with the village attorney regarding this matter. Voting Aye: Eddy, Einspahr, Hammond, Orcutt and Valentine. There were no votes against the motion. Motion carried. Motion by Einspahr, seconded by Valentine to approve the building permit for the patio at 14 West Avenue. Voting Aye: Eddy, Einspahr, Hammond, Orcutt and Valentine. There were no votes against the motion. Motion carried. Motion by Orcutt, seconded by Valentine to approve the building permit for the garage at 14 West Ave. Voting Aye: Eddy, Einspahr, Hammond, Orcutt and Valentine. There were no votes against the motion. Motion carried. Motion by Hammond, seconded by Einspahr to approve the building permit for a garage at 106 West Ave. Voting Aye: Eddy, Einspahr, Hammond, Orcutt and Valentine. There were no votes against the motion. Motion carried. Motion by Hammond, seconded by Einspahr to approve the shed at 106 West Ave. Voting Aye: Eddy, Einspahr, Hammond, Orcutt and Valentine. There were no votes against the motion. Motion carried.

Ordinance 305 was introduced by Trustee Eddy. Ordinance 305 reads: AN ORDINANCE OF THE VILLAGE OF REPUBLICAN CITY, HARLAN COUNTY, NEBRASKA; TO AMEND ORDINANCE NO. 271 OF THE VILLAGE OF REPUBLICAN CITY, HARLAN COUNTY, NEBRASKA, PROVIDING FOR THE RATES FOR THE CONSUMERS OF THE VILLAGE WATER SYSTEM AND VILLAGE SWER SYSTEM SHALL BE CHARGED; PROVIDING FOR THE DISCONNECTION OF WATER SERVICE, ESTABLISHING LATE FEES AND ESTABLISHING FEES FOR RE-CONNECTION, PROVIDING FOR A HOOK-UP FEE FOR VILLAGE WATER AND SEWER SERVICES; REPEALING ALL ORDINANCES OR RESOLUTIONS OR PARTS THEREOF IN CONFLICT WITH THIS ORDINANCE; AND PROVIDING FOR THE TIMES THIS ORDINANCE SHALL BE IN FULL FORCE AND EFECT. Motion by Valentine, seconded by Hammond to suspend the rule requiring three separate readings of the ordinance. . Voting Aye: Eddy, Einspahr, Hammond, Orcutt and Valentine. The opening of bids for Block 21, Lot 32 has been postponed until November 5, 2018 due to an error in the Notice of Sale. Corrected Notice of Sale has been sent to the paper and posted.

Discussion was held regarding damage to the south garage door tracks and casing at the fire hall. We have been unable to get anyone to look at the casing. Chairman Eddy will contact a local business owner to see what they can do. Insurance check has been received.

The next regular scheduled village board meeting will be held Monday, November 5, 2018 at 5:30 p.m. at the Fire Hall. Meeting is open to the public and the public is encouraged to attend.
